
The Supreme Court this Tuesday sacked Emeka Ihedioha as governor of Imo state, and affirmed Hope Uzodinma as winner of the March 9 gubernatorial election.
The Independent National Electoral Commission (INEC) had declared Ihedioha winner of the election but Uzodinma challenged the outcome of the election in court.
Ihedioha ran on the platform of the Peoples Democratic Party (PDP) while Uzodinma contested as the All Progressives Congress (APC) candidate.
In a unanimous decision, a seven-man panel held that Ihedioha did not win majority of votes cast in the election because the votes due to Uzodinma were unlawfully excluded from 318 polling units.
The court therefore held that the lower courts erred in law when it were rejected evidence tendered before them to the extent that votes from the 318 polling units were not credited to the APC and Hope Uzodinma.
Justice Kudirat Kekere-Ekun, the judge who read the judgement, ordered INEC to withdraw the Certificate of Return issued to Ihedioha and give a fresh one to his APC rival, Uzodinma.
