The Nigerian Army Special Court Martial has pronounced Judgement on the case of Nigeria Army vs Major General Umar Mohammed with 14 guilty verdicts out of 18 count charges levelled against him on Tuesday, 10th October 2023.
According to Major General James Myam, the President of the Court Martial in a release, “all the sentences are to run concurrently which are subject to confirmation of the Military Council”.
This follows the pronouncement of the court Marshall led by the President of the Court Martial, Major General James Myam, on its findings on the 4th of October 2023, at the Army Headquarters Command Officers Mess Abuja.
Major General Myam while making the sentencing on behalf of his colleagues gave the judgements as follows: Count 1 was charged with stealing, the accused was found guilty and sentenced to 5 years imprisonment and ordered the General to pay back the sum of one million and forty-five thousand, four hundred United States Dollars to Nigerian Army Properties Limited.
Similarly, on Counts 2, 3, 4, 5, and 6, the Senior Officer charged with stealing on these counts was found and sentenced to 5 years imprisonment with orders to pay various sums of money stolen. On Count 7, the court found General Um Mohamed not guilty and was discharged and acquitted.
Count 8 charged with forgery, the court found the officer guilty as charged and sentenced to 7 years imprisonment.
On Count 9, General UM Mohammed was charged with theft and found guilty. The court pronounced a 5-year imprisonment sentence and ordered him to pay back the sum of four hundred and thirty thousand, eight hundred us dollars ($430,800) to Nigeria Army Properties Limited of dollars to Nigerian Army Properties Limited.
Count 10, conspiracy to forge the document, Findings not guilty, Discharge and acquired, Count 11, findings not guilty, Discharge and acquitted.
Count 12, Conduct to prejudice of service discipline, findings guilty and Sentence two years imprisonment.
Count 13 theft, found guilty, sentenced to 5 years imprisonment and ordered to pay back 74 million to Nigerian Army Properties Limited. Count 14, criminal misappropriation, found guilty and sentenced to 2 years imprisonment and further ordered the officer to pay back the sum of 590 million naira to FCC NAPIL Properties Limited.
Count 15, Criminal misappropriation, found guilty and sentenced to 2 years imprisonment and further ordered the payment of 255 million naira.
Count 16, criminal misappropriation, findings guilty and sentence of two years in prison. Ordered to pay back the sum of five hundred and fifty-nine million, one hundred and seventy-two thousand naira.
Count 17 criminal misappropriation and found not guilty, was therefore discharged and acquitted. Count 18, criminal misappropriation, found guilty and Sentenced to two years in prison.
He was also ordered to pay back the sum of N172 million.
